ANIRUDDHA EKNATH LATPATEversusTHE STATE OF MAHARASHTRA AND ANOTHER

Disposal
DISPOSED OFF

Holding

Respondent No.2 must consider the petitioner's representation dated 25/11/2016 and decide the same within eight weeks from the date of the order.

Summary

The petitioner, Aniruddha Eknath Latpate, filed a writ petition seeking a directive that the Superintendent of Police, Parbhani, consider a representation he submitted on 25 November 2016. He relied on a prior judgment of this Court (Writ Petition No.12966/2017) which held that interest at 12% per annum is payable on gratuity amounts. The Court was asked to order the respondent to decide the representation within a specific time frame. The Bench, after noting the earlier decision, directed the respondent to consider the representation and render a decision within eight weeks from the date of the order. No substantive discussion on the merits of the representation was required; the order was purely procedural. The petition was therefore disposed with the said directions.

Issues considered

  • Whether the Superintendent of Police, Parbhani, is obligated to consider the petitioner's representation dated 25/11/2016 and decide on it within a stipulated period, in view of the earlier judgment on gratuity interest.
