PARBHANI EDUCATION SOCIETY PARBHANI THROUGH ITS PRESIDENT MOHAMMAD ABDUL RASHEED ENGINEERversusTHE STATE OF MAHARASHTRA AND ANOTHER

Disposal
DISPOSED OFF

Holding

The Court held that the subsequent approval of the petitioners' appointments obviated the relief sought, and ordered the remaining procedural steps to be completed.

Summary

The petitioners, Miss Shaista Anjum Syed Asger and others, filed writ petitions challenging the non-approval of their appointments as primary teachers. The Education Officer subsequently approved their appointments on 9 April 2026, rendering the petitions moot. The petitioners' counsel submitted a Government Resolution dated 12 June 2026, seeking that the remaining respondents forward complete proposals for inclusion of the petitioners' names in the Shalarth ID to the Deputy Director of Education. The Court directed respondents No.2 to 4 to submit the proposals within four weeks and the Deputy Director to process them within six weeks, in accordance with applicable rules and resolutions. Consequently, the Court disposed of all writ petitions and the pending civil application.

Issues considered

  • What is the appropriate remedy when an appointment is subsequently approved after a writ petition challenging its denial?
  • Whether the respondents are required to forward complete proposals for inclusion of the petitioners' names in the Shalarth ID as per the Government Resolution.
