- DISPOSED OFF
Holding
Since the inquiry found no illegality in the land allotment, the Court held that there is no propriety to direct the authorities to act and dismissed the petition.
Summary
The petitioners filed a writ petition alleging a bogus allotment of land (Survey No. 56, Kadiwadgaon village, Beed district) and sought court‑ordered action against the authorities. They relied on a representation dated 29‑01‑2014 submitted by the Tahsildar, which indicated that an inquiry had been conducted. The inquiry report concluded that 89 plot‑holders were occupying the plots and that no illegality was found in the allotment. The High Court examined the findings of the inquiry and held that there was no basis to direct the authorities to take any further action. Consequently, the Court disposed of the writ petition without granting any relief to the petitioners.
Issues considered
- Whether the alleged bogus allotment of land warrants judicial intervention.
- Whether the petitioners' representations can compel the authorities to take action despite the inquiry finding no illegality.
- Whether any illegality exists in the land allotment that would justify a court order.
