The Court directed the District Magistrate to dispose of the pending application within four weeks, emphasizing the priority of such applications under the Securitisation Act.

Summary

Piramal Capital and Housing Finance Ltd filed a writ petition seeking a court direction to the District Magistrate of Daman to decide a pending application (No.15 of 2022) filed under Section 14 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. The petitioner argued that such applications must be decided on a priority basis. The Court examined whether it could issue a mandatory time‑bound direction to a magistrate for disposal of the application. It held that applications under the Securitisation Act deserve priority and the magistrate could be directed accordingly. Consequently, the Court ordered the District Magistrate to hear and dispose of the pending application within four weeks and disposed of the writ petition.
