The Court held that the inquiry was conducted per the Act and there was no ground to interfere, thereby dismissing the petition.
Summary
The petitioner, Ahmednagar Jilha Prathamik Shikshan Sahakari Bank Ltd (through its director), challenged the order dated 12 September 2018 of the Divisional Joint Registrar Co‑Societies, Nashik, which dismissed its revision of an inquiry conducted under Section 83 of the Maharashtra Co‑operative Societies Act, 1960. The inquiry had been initiated by the District Deputy Registrar, an Inquiry Officer was appointed, and the petitioner was heard before a report was submitted on 29 July 2017. The petitioner filed a revision against the report, which the Revisional Authority upheld, finding the inquiry complied with statutory procedure. The High Court examined whether any procedural or jurisdictional error existed in the revisional order. Finding that the inquiry was conducted in accordance with law and that the Revisional Authority had correctly applied its powers, the Court dismissed the writ petition. No costs were awarded.

PER COURT :
1. Heard the learned Counsel for the respective parties.
2. By way of the present petition, the Petitioner assails the order
dated 12.09.2018 passed by Respondent No.2, i.e. Divisional Joint
Registrar Co-Societies, Nashik Division, Nashik in Revision Application
No.R-170/2017, whereby, the Revision filed by the Petitioner came to
be dismissed.
3. The proceeding arises out of an inquiry initiated under Section
83 of the Maharashtra Co-operative Socities Act, 1960 (For short ‘the
Act’). On consideration of the record available, it is found that the
District Deputy Registrar, after following due procedure, appointed an
Inquiry Officer, who submitted his report dated 29.07.2017. From the
record, it further reveals that, while conducting the inquiry under
Section 83 of the Act, the Petitioner was duly heard and after

considering the material on record, the inquiry report was submitted.
The said report was assailed by the Petitioner by filing a Revision.
4. The Revisional Authority, upon considering the entire record
placed before it, found that the inquiry was conducted in accordance
with due procedure of law. In view of the observations and findings
recorded by the learned Revisional Authority, I do not find any reason
to interfere with the order dated 12.09.2018 passed by Respondent
No.2, i.e. Divisional Joint Registrar Co-Societies, Nashik Division,
Nashik in Revision Application No.R-170/2017.
5. Hence, the petition stands dismissed. No order as to costs.
