Bombay High Court

RAJESHKUMAR NARAYAN KOTTAPALLIversusTHE STATE OF MAHARASHTRA THROUGH ITS SECRETARY AND ANOTHER

Disposal
DISPOSED OFF

Holding

The Court ordered the Scrutiny Committee to decide the petitioner's tribe claim within four months, thereby disposing of the writ petition.

Summary

Petitioner Rajeshkumar Narayan Kottapalli filed a writ petition seeking speedy disposal of his claim of belonging to the Mannervarlu Scheduled Tribe, which had been pending before the Scrutiny Committee since April 2, 2018. The Court examined whether the prolonged delay infringed the petitioner's rights and whether it could intervene to compel the administrative body to act. It held that the undue delay warranted judicial intervention to ensure timely adjudication. Consequently, the Court directed the Scrutiny Committee to decide the tribe claim within four months from the date of the order. With this direction, the writ petition was disposed of.
