MASIRA BI HANIF PATELversusUNION OF INDIA

Decided
Disposal
DISPOSED OFF

Holding

The prayer for allocation of Central Pool Quota seats for the 2024-25 academic year is infructuous as the admission process has ended, and the petition is disposed.

Summary

The petitioner, Jitendra Shankar Masira Bi Hanif Patel, filed a writ petition seeking that the Union of India allocate seats under the Central Pool Quota Scheme for MBBS/BDS courses, incorporating reservation for PMRBP awardees for the 2024-25 academic year. The Court examined whether such an order could be issued given the timing of the admission process. It held that the admission process for 2024-25 had already concluded, rendering the prayer infructuous. The Court allowed the petitioner to file a fresh petition for any subsequent academic year. Consequently, the present petition was disposed of without any order as to costs.

Issues considered

  • Whether the Court can direct allocation of Central Pool Quota seats for MBBS/BDS admissions for the 2024-25 academic year
