The Court did not decide the merits but directed the Commission to decide on the Committee’s recommendation within four weeks and allowed the petitioner’s application to proceed subject to that decision.

Summary

The Association of Management of Ayurvedic Medical Colleges of Maharashtra filed a writ petition challenging the applicability of the 2024 Regulations to its BAMS programme for the academic year 2026‑27. The petition sought interim permission to continue the course while the grievance was being examined. The Court, without addressing the merits, ordered the National Commission for Indian System of Medicine to consider the Committee’s recommendation on the matter and to decide within four weeks. It further directed that the petitioner’s application for continuation of the BAMS course be processed independently, subject to the Commission’s decision, and that the decision not be acted upon for two weeks thereafter. The Court disposed of the writ petition, clarified that the order is not precedent, and awarded no costs.

Issues considered

  • Whether the 2024 Regulations are applicable to the BAMS course of the petitioner
