Bombay High Court

SALONI PRADEEP PATILversusTHE DIRECTOR MEDICAL COUNSELLING COMMITTEE MINISTRY OF HEALTH AND FAMILY WELFARE

Decided
Disposal
Disposed Off

Holding

The court held that admission will be granted only after the petitioner complies with the college's stipulated requirements, and the provisional allotment letter will cease to apply if compliance is not achieved.

Summary

The petitioner, Saloni Pradeep Patil, sought a writ directing the admission of her son to Dr. D.Y. Patil Medical College, Pune. The college stipulated that admission would be granted only after the petitioner complied with specific procedural requirements, including registration at the admissions cell, submission of documents, and obtaining an admit card. The court noted that the provisional allotment letter issued by the Medical Council of India (MCC) would become void if these requirements were not met. Accordingly, the court ordered the petitioner to fulfill the college’s requisites and held that admission would be granted upon compliance, with no costs awarded. The writ petition was therefore disposed of.

Issues considered

  • Whether the petitioner is entitled to admission without complying with the college's procedural requirements.
  • Whether the provisional allotment letter can be rendered inapplicable for non‑compliance with the college's conditions.
