Bombay High Court

MUKTAI KISHORE JADHAVversusTHE STATE OF MAHARASHTRA THROUGH ITS SECRETARY AND ANOTHER

Disposal
DISPOSED OFF

Holding

The Court directed the Scrutiny Committee to decide the petitioner’s Scheduled Tribe claim within six months.

Summary

The petitioner, Muktai Kishore Jadhav, filed a writ petition seeking a direction for the Scrutiny Committee (Respondent No.2) to decide his claim of belonging to the ‘Thakur’ Scheduled Tribe, a matter pending since 12 September 2025. The petitioner argued that a prompt decision was essential for his admission to a further professional course. The Court examined the need for expeditious adjudication of tribe claims under the constitutional safeguards for Scheduled Tribes. Considering the petitioner’s educational aspirations, the Court directed the Scrutiny Committee to decide the claim within six months from the date of the order. No substantive discussion on the merits of the claim was made, as the relief sought was procedural. Consequently, the writ petition was disposed of after granting the direction.
