SURESH HARIBHAU HAJAREversusTHE STATE OF MAHARASHTRA AND OTHERS

Disposal
DISPOSED OFF

Holding

The Court held that the Scrutiny Committee’s order denying the petitioner’s claim to Koli Mahadev Scheduled Tribe status was unlawful and quashed it, directing issuance of a tribe‑validity certificate subject to pending re‑opening proceedings.

Summary

The petitioner, Suresh Haribhau Hajare, challenged a Scrutiny Committee order dated 04‑03‑2026 that invalidated his claim to belong to the ‘Koli Mahadev’ Scheduled Tribe. The petition was filed under Article 226 of the Constitution seeking a tribe‑validity certificate. The Court noted that a similar petition (Writ Petition No. 2723 of 2026) had already been decided, resulting in the quashing of the same order. Relying on that precedent and the lack of any substantive justification for the Committee’s denial, the Bench partially allowed the writ. It quashed the impugned order, directed the Committee to issue a tribe‑validity certificate to the petitioner, subject to the outcome of pending re‑opening proceedings, and barred the petitioner from claiming any equity thereafter.

Issues considered

  • The legality of the Scrutiny Committee’s order invalidating the petitioner’s Scheduled Tribe status.
  • Whether the petitioner is entitled to a tribe‑validity certificate pending re‑opening of the validity proceedings.
  • Whether the order was issued in violation of procedural fairness under Article 226.
