SADHANA SUBHASH KADAMversusTHE STATE OF MAHARASHTRA THR SEC. PERSON WITH DISABILITIES WELFARE DEPT. AND ORS

Decided

Holding

The petition is dismissed as the petitioner has complied with the notice by submitting the UDID Card.

Summary

The petitioner, Jitendra Shankar, filed a writ petition challenging a notice issued by the State of Maharashtra's Disability Welfare Department that required him to submit his Unique Disability ID (UDID) Card. The petitioner produced a UDID Card based on a disability certificate dated 14 March 2012, which had been ratified by the relevant medical committee. The respondent argued that the notice merely asked for the UDID Card and did not demand a fresh disability certificate. The Court found that the petitioner had complied with the notice by submitting the UDID Card, and therefore there was no remaining ground for relief. Consequently, the petition was dismissed without any order as to costs.

Issues considered

  • Whether the notice issued to the petitioner required submission of a fresh disability certificate in addition to the UDID Card
  • Whether the petitioner’s compliance with the notice by submitting the UDID Card suffices to dispose of the writ petition

and 4 has submitted that the impugned Notice dated 9th February

office as soon as possible. He has further submitted that the said

Notice nowhere states that a fresh disability certificate is required to

be obtained by the Petitioner along with the UDID Card.

Card and which is tendered to this Court and taken on record and

marked ‘X’ for identification, nothing survives in the Petition.

the UDID Card has been complied with.

5. The prayers in the Writ Petition are accordingly worked

out. The Writ Petition is disposed of. There shall be no order as to
