Bombay High Court
PURUSHOTTAM RATANLAL TAPADEversusTHE STATE OF MAHARASHTRA AND OTHERS
- Disposal
- DISPOSED OFF
Holding
The petition is disposed, directing the petitioner to seek revision under Section 9 of the Maharashtra Money‑Lending (Regulation) Act, 2014.
Summary
The petitioner, Purushottam Ratanlal Tapade, challenged an order dated 31.12.2018 issued by the Divisional Joint Registrar, Co-operative Societies, Latur, in Appeal No. 102/2018. The High Court observed that the petitioner has an alternate and equally efficacious remedy by filing a revision before the Registrar, General, Money-Lending, Pune under Section 9 of the Maharashtra Money‑Lending (Regulation) Act, 2014. Consequently, the Court disposed of the writ petition, granting the petitioner liberty to file the revision within eight weeks. The interim order dated 24.04.2019 was ordered to remain in force until the revisional authority decides the matter on its merits. The Court clarified that it has not made any findings on the merits and that the revisional authority must decide the revision within six months of filing.
Issues considered
- Whether the petitioner must approach the revisional authority under Section 9 of the Maharashtra Money‑Lending (Regulation) Act, 2014 instead of proceeding with the writ petition.
- Whether the writ petition is maintainable when an alternative statutory remedy is available.
