PRANALI PRAKASH JAMADAR MINOR THROUGH HER MOTHER SWATI PRAKASH JAMADAR AND ANRversusTHE STATE OF MAHARASHTRA THROUGH ITS SECRETARY AND ANR

Disposal
DISPOSED OFF

Holding

The Court directed the Scrutiny Committee to decide the petitioner’s tribe claim by the end of July 2026.

Summary

The petitioner, a minor represented by her mother, filed a writ petition seeking a court direction for the Scrutiny Committee to determine her claim of belonging to the ‘Koli Mahadev’ Scheduled Tribe, a matter that had been pending since 4 September 2025. The petitioner argued that a prompt decision was essential for her to pursue higher studies. The State, represented by the Attorney General, opposed the intervention, contending that the committee’s process should not be judicially directed. The Court examined whether it could issue a directive to an administrative body to expedite a tribal status determination. Considering the petitioner’s educational aspirations and the undue delay, the Court ordered the Scrutiny Committee to decide the claim by the end of July 2026. Consequently, the writ petition was disposed.
