Bombay High Court

SURYAKANT AMRUTA SUREWADversusTHE STATE OF MAHARASHTRA THROUGH ITS PRINCIPAL SECRETARY AND ANOTHER

Disposal
DISPOSED OFF

Holding

The Court allowed the writ petitions and directed the Scrutiny Committee to issue validity certificates to the petitioners belonging to the Mannervarlu Scheduled Tribe.

Summary

The petitioners, members of the Mannervarlu community, sought recognition as a Scheduled Tribe and validation of their caste certificates. Their applications were previously rejected by the Scrutiny Committee, prompting multiple writ petitions. The Court noted that a related petition by Shankar s/o Laxman Mali, whose claim was upheld, had already been allowed, establishing a precedent for the petitioners. Relying on that decision and the undisputed familial relationships, the Court chose not to re‑examine the factual matrix. Consequently, the Court allowed all the writ petitions and ordered the Scrutiny Committee to issue validity certificates to the petitioners, subject to any future reopening of the validation proceedings.

Issues considered

  • Whether the petitioners belong to the Mannervarlu Scheduled Tribe and are entitled to caste certificate validation.
  • Whether the Scrutiny Committee's refusal to issue validity certificates can be set aside in view of the earlier judgment in favor of Shankar s/o Laxman Mali.

Subjects

  • Scheduled Tribe
  • Caste Certificate Validation
  • Writ Petition
  • Validity Certificate
  • Scrutiny Committee
