The petition is allowed and the FIR and charge‑sheet are quashed.
Summary
The petitioners, Fahim Aslam Shaikh and another, filed a writ petition under Article 226 of the Constitution and Section 528 of the Bharatiya Nagarik Suraksha Sanhita seeking quash of FIR No. 193/2023 and charge‑sheet PW/3259/2024 relating to offences under IPC sections 323, 498A, 406, 504, 506 and 34. The wife (Respondent No.2) submitted an affidavit stating she had no objection to the quash and that the matrimonial dispute was settled, and the State also agreed that continuation of the criminal proceedings served no purpose. The Court, relying on Supreme Court decisions in Gian Singh v. State of Punjab, Parbatbhai Aahir v. State of Gujarat, and Narinder Singh v. State of Punjab, held that there was no impediment to quash the proceedings. Accordingly, the petition was allowed, the FIR and charge‑sheet were quashed, and each of the husband and wife were ordered to pay costs of Rs.20,000. The parties were directed to deposit the costs and file a compliance affidavit.
Issues considered
- Whether a criminal proceeding can be quashed under Article 226 and Section 528 BNSS when the parties have settled their dispute and the complainant files an affidavit of no objection.
- Whether the Supreme Court precedents permit the court to intervene and quash FIRs in matrimonial dispute contexts.
