Bombay High Court
KONDAPPA SADASHIV KOREversusTHE UNION OF INDIA AND OTHERS
- Disposal
- DISPOSED OFF
Holding
The petition is not maintainable as the court lacks jurisdiction and expertise to direct railway infrastructure matters.
Summary
The petitioner, Kondappa Sadashiv Kore, filed a writ petition seeking a direction to the Indian Railways to construct a new railway station at Kallam Road near Kasbe Tadwale and to order all trains to halt there. The High Court examined whether it had the jurisdiction and expertise to entertain such a request. The Court observed that decisions regarding railway infrastructure are within the purview of railway authorities and not within the court's expertise. Consequently, the Court found that the petition was not maintainable. The writ petition was therefore disposed of without any order directing the construction of a station or halting of trains.
Issues considered
- Whether the High Court has jurisdiction to direct the construction of a railway station and order train halts.
- Whether the writ petition is maintainable under the appropriate provisions of law.
