The petitioners are entitled to the one‑step pay scale and arrears, and the respondent authority must verify records and implement the Government Resolution accordingly.
Summary
The petitioners, education officers employed by the Zilla Parishad, filed writ petitions seeking salary benefits under the one‑step pay scale applicable to employees working in Tribal and PESA areas, as per the Government Resolution dated 29‑02‑2024. The issue was whether the respondents were required to verify the petitioners' service records and, if no legal impediment existed, to grant the enhanced pay and arrears. The Court referred to its earlier decisions in Writ Petition No. 248 of 2026 and Writ Petition No. 13241 of 2024, which had addressed the same question. It ordered the Education Officer to scrutinise the records within 30 days, clear eligible cases, and pay the entitled salary benefits and arrears, while providing a hearing for any petitioners found ineligible. The Court thus allowed the writ petitions and directed the respondents to implement the Government Resolution accordingly.
Issues considered
- Whether the petitioners are entitled to the one‑step pay scale and arrears under the Government Resolution dated 29‑02‑2024.
