Bombay High Court

RAHUL GANPAT JAWAREversusTHE STATE OF MAHARASHTRA AND OTHERS

Disposal
DISPOSED OFF

Holding

The writ petition is disposed, and the petitioner is permitted to file a revision under Section 154 within six weeks.

Summary

Rahul Ganpat Jaware filed a writ petition challenging an order and sought to contest it by filing a revision under Section 154 of the Maharashtra Co-operative Societies Act, 1960. The petitioner’s counsel, Satyajit S. Bora, argued that the order was amenable to revision. The Court observed that the petition could indeed be pursued through a revision petition under the specified statutory provision. Consequently, the Court disposed of the present writ petition, granting the petitioner liberty to file a revision within six weeks from the date of the order. The Court also directed that any delay in prosecuting the revision petition be taken into account by the revisional authority when considering condonation of delay, and left all points open for consideration in the revision proceeding.
