Holding
The High Court held that there was no error in the Family Court’s order changing the place of visitation and therefore dismissed the challenge.
Summary
The petition challenged a Family Court order dated 04‑07‑2024 that required the mother to bring her minor child to the District Legal Service Authority on specified Saturdays for visitation with the father. The petitioner argued that a recall application filed against the original visitation order dated 26‑07‑2023 had not been decided, and that detailed objections alleging physical and mental abuse by the father were ignored. The petitioner also contended that the father’s failure to pay child maintenance and a pending Section 24 application under the Hindu Marriage Act should preclude visitation, and questioned the propriety of filing a Section 26 application after the divorce petition. The High Court examined the allegations, held that the Family Court merely altered the place of meeting without affecting the substantive visitation order, and found no error in the order. It directed that the pending recall application may be pressed and decided expeditiously, but otherwise disposed the petition.
Issues considered
- Whether the Family Court order changing the place of child visitation is valid despite a pending recall application and unconsidered objections.
- Whether allegations of abuse and non‑payment of maintenance justify revoking or modifying visitation rights.
- Whether an application under Section 26 of the Hindu Marriage Act can be filed after a divorce petition.
- Whether a pending Section 24 application affects the father's right to meet the child.

4. From the perusal of the aforesaid objections, it is apparent that there are
certain allegations against the respondent, which are yet to be considered
and decided after considering the evidence. There is no objection to the
effect that in case, respondent is permitted to meet the child, that will not
be in the welfare of the child or there is any chance of an injury or
otherwise prejudicial to the interest of the minor child.
5. It has also been contended by learned counsel for the petitioner that the

application under Section 26 of Hindu Marriage Act, 1955 has been filed
only after filing of the divorce petition and prior to that no interest has
been shown by the husband of the petitioner in the child.
6. There is nothing wrong in filing an application under Section 26 of
Hindu Marriage Act, 1955 after filing of the divorce petition.
7. It has also been submitted by learned counsel for the petitioner that
respondent is not paying anything for maintenance of child, and therefore
he should not be permitted to meet the child.
8. On a query being made by this Court, it has been stated by learned
counsel for the petitioner that an application under Section 24 of the
Hindu Marriage Act is already pending.
9. In view of these facts, I do not find any error in the order impugned
passed by the Family Court. The court below has passed only an order
changing the place of meeting in pursuance of its earlier order.
10. So far as recall application filed by the petitioner is concerned, it is
provided that the petitioner may press the recall application and in case,
he presses the recall application, the same shall be considered and decided
by the court below in accordance with law expeditiously, preferably
within a period of twelve weeks from the date of production of certified
copy of this order after providing opportunity of hearing to all the parties
concerned provided there is no other legal impediment.
11. Accordingly, the petition stands disposed of.
