Allahabad High Court

AMARWATIversusBACHCHU SINGH AND 4 OTHERS

Decided

Holding

The High Court directed the Civil Judge to decide the pending application within four months and disposed of the writ petition without reaching the merits.

Summary

The petition was filed by the proposed defendant seeking a direction for the speedy disposal of an application filed under Order IX Rule 13 read with Section 151 of the CPC, which was pending in the Civil Suit No. 22 of 2022 where the plaintiffs‑respondents had obtained an ex‑parte decree. The petitioner asked the High Court, invoking its supervisory jurisdiction under Article 227, to order the civil court to hear the pending application promptly. The Court observed that there was no merit in entertaining a full hearing of the writ petition and that the appropriate relief was to direct the lower court to decide the application within a stipulated time. Accordingly, the Court directed the Civil Judge (Junior Division)‑5th, District Mathura to decide the application within four months of the certified copy of the order, and disposed of the writ petition without adjudicating the merits. The order emphasizes that the High Court has not decided the substantive issues of the underlying civil suit.
