Allahabad High Court

DEEPAKversusANIL SINGH

Decided

Holding

The High Court exercised its supervisory jurisdiction under Article 227 to direct the lower court to decide the pending application within three months and disposed the petition without reaching the merits.

Summary

The petitioner, Deepak, filed a petition under Article 227 seeking a writ directing the Additional Civil Judge (Junior Division) Court No.11, Prayagraj to decide his pending application 14C dated 03.11.2025 in case 2505 of 2025. The petition merely requested expeditious disposal of that application without raising any substantive dispute. The High Court observed that no further procedural steps such as counter‑affidavit or notice were necessary at the admission stage. Accordingly, it ordered the lower court to decide the pending application within three months of receiving a certified copy of the order, after hearing all affected parties. The petition was then disposed without any merits being adjudicated.
