Allahabad High Court

BHIMversusRAM AASHISH AND 5 OTHERS

Decided

Holding

The High Court disposed of the writ petition at the admission stage and directed the Civil Judge to decide the 6‑C application, without adjudicating the merits.

Summary

Bhim filed a writ petition under Article 227 seeking a direction to the Civil Judge (Senior Division) in Deoria to decide a Section 6‑C application filed in Suit No. 24 of 2026. The High Court, noting that no useful purpose would be served by keeping the petition pending, disposed of it at the admission stage without calling for a counter‑affidavit or issuing notice to the private respondents. The Court directed the Civil Judge to decide the 6‑C application in accordance with law, after hearing all affected parties, preferably within one month of receiving a certified copy of the order. The petition was therefore disposed of, and the Court expressly stated that it had not adjudicated the merits of the underlying dispute.
