Allahabad High Court

JANAKIversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The High Court exercised its Article 227 jurisdiction to direct the Family Court to conclude the pending case within six months.

Summary

The petitioner, Janaki, filed a petition under Article 227 of the Constitution seeking a direction to the Principal Judge of the Family Court in Jaunpur to conclude the pending family law case (Case No. 1704 of 2024) against Pankaj within a fixed time. The petitioner, represented by counsel Vivek Kumar Singh, argued that the trial was unduly delayed and that a time‑bound order was necessary to protect her rights as a wife. The High Court, after considering the facts and the petitioner's submission, exercised its supervisory jurisdiction to ensure the proper administration of justice in the lower court. It directed the Family Court to decide the matter within six months from the date a certified copy of the order is produced. No substantive merits of the underlying family dispute were addressed; the order solely concerned procedural expeditious disposal. The petition was disposed with the direction being granted.
