Allahabad High Court

INDRAVATIversusSABHAPATI AND 4 OTHERS

Decided

Holding

The writ petition is dismissed and the Civil Judge (Junior Division)-Vth, Jaunpur is directed to decide Misc. Case No.115 of 2013 within three months.

Summary

Indravati, the defendant, filed a writ petition under Article 227 seeking an order directing the Civil Judge (Junior Division)-Vth, Jaunpur to decide Misc. Case No.115 of 2013 expeditiously. The petition arose from an ex-parte decree against her in the original suit. The High Court observed that keeping the writ petition pending or issuing notices would serve no useful purpose. Accordingly, the Court directed the lower court to decide the pending miscellaneous case within three months of receiving the certified copy of the order, after hearing all affected parties. The writ petition was disposed without any merits being adjudicated.
