Allahabad High Court

OM SINGHversusNARENDRA PAL SINGH AND 3 OTHERS

Decided

Holding

The High Court directed the Additional District Judge to decide the pending civil revision by the next scheduled date or within two months, and disposed of the writ petition.

Summary

The petitioner, Om Singh, filed a writ petition under Article 227 seeking a direction to the Additional District Judge, Court No.06, Muzaffarnagar, to decide Civil Revision No.97 of 2025, which had been pending for over a year despite dates being fixed. The petitioner argued that the delay served no useful purpose and requested the revision be decided by the next scheduled date of 29‑09‑2026 or within two months of the order. The High Court, without calling for a counter‑affidavit or issuing notice to the private respondents, disposed of the petition at the admission stage and issued a direction to the lower court to decide the revision by the next date or within two months after the certified copy of the order is produced. The direction was given in accordance with law after hearing all affected parties. Consequently, the writ petition was disposed of.

                                                         HON'BLE ROHIT RANJAN AGARWAL, J.

                                    1. This writ petition has been filed with the following prayer:-

"i. Allow the Petition, directing the Additional District Judge, Court No.06, Muzaffarnagar

to decide the Civil Revision No.97 of 2025 (Om Singh versus Narendra Pal Singh and 3

others), pending in the Court Additional District Judge, Court No.06, Muzaffarnagar

arising out of Original Suit No.666 of 1996(Om Singh versus Narendra Pal Singh and

others), pending in the Court of Civil Judge (Junior Division), Fast Track Court,

                                          Muzaffarnagar."

                                    2. It is contended that a civil revision is pending consideration in which dates have
been fixed, but the same has not been decided for the last one year. The prayer made
in the writ petition is for expediting the said revision. According to petitioner's
counsel, next date fixed in the matter is 29.09.2026.

                                    3. As no useful purpose would be served in keeping the matter pending, the writ
petition is being disposed of, at the admission stage, without calling for counter
affidavit or issuing notice to private respondents, with a direction upon Court
concerned to proceed with the Civil Revision No.97 of 2025, and decide the same by
the next date fixed, or within two months from the date of production of certified copy
of this order, in accordance with law, after hearing all affected parties.

                                    4. With the aforesaid direction, present writ petition stands disposed of.

                                                                                                     (Rohit Ranjan Agarwal,J.)
