Holding
The High Court directed the Family Court to decide the pending case within six months, exercising its supervisory jurisdiction under Article 227.
Summary
The petitioner, Smt. Sanju Kumari, filed a petition under Article 227 of the Constitution seeking a direction to the Principal Judge of the Family Court, Mathura, to expedite the disposal of a pending family law case (Case No. 183 of 2025) arising under Section 144 of the B.N.S.S. Police Station. The petitioner argued that the delay in the family court proceedings was causing hardship, emphasizing that she is the wife in the matter. The High Court considered the petition and the counsel’s submissions, noting its supervisory jurisdiction over lower courts. It held that it could issue a directive to ensure timely adjudication. Consequently, the Court ordered the Family Court to decide the case within six months from the date of production of a certified copy of the order, and disposed of the petition.
