Allahabad High Court

SUDHEENDRA KUMAR SINGHversusRINKI SINGH

Decided

Holding

The High Court, exercising its supervisory jurisdiction under Article 227, directed the Chief Judicial Magistrate to dispose of the complaint within one year.

Summary

The petitioner, Sudheendra Kumar Singh, filed a petition under Article 227 seeking a direction to the Chief Judicial Magistrate of Azamgarh to expedite the disposal of Complaint Case No. 291 of 2020, which involves offences under Sections 498A, 504, 506 of the IPC and Sections 3 and 4 of the Dowry Prohibition Act. The petitioner, who is the husband in the matter, argued that the proceedings were suffering inordinate delay and that a time‑bound order was necessary to secure the ends of justice. The High Court, invoking its supervisory jurisdiction, examined whether it could direct a lower court to decide a pending criminal case within a stipulated period. It held that such a direction is permissible to prevent undue delay and to ensure fair trial. Consequently, the Court ordered the Chief Judicial Magistrate to dispose of the complaint preferably within one year of the certified copy of the order and dismissed the petition.

Issues considered

  • Whether the High Court can, under its supervisory jurisdiction under Article 227, direct a Chief Judicial Magistrate to decide a pending criminal complaint within a specified time frame.
  • Whether such a direction is necessary to prevent inordinate delay and to secure the ends of justice.
