Holding
The High Court directed the Sessions Judge to decide the pending criminal revision within six months, thereby disposing of the petition.
Summary
Petitioner Kaushik Shukla filed a petition under Article 227 seeking an order directing the State to release seized money of Rs.2,190,000 and other articles, based on an order of the Judicial Magistrate dated 18‑09‑2025. The State had filed Criminal Revision No.271/194 of 2025, which remains pending before the Sessions Judge, Jalaun at Orai. The petitioner argued that justice would be served if the revision were decided promptly, while the State raised no objection. The High Court, after considering the submissions, disposed of the petition by directing the Sessions Judge to decide the pending criminal revision within six months of the certified copy of the order. No order was made directly releasing the seized amount; instead, the court emphasized a time‑bound disposal of the revision.
Issues considered
- Whether the High Court can, under Article 227, direct a Sessions Judge to decide a pending criminal revision within a specified time frame.
