Allahabad High Court

LALIT KUMARversusSTATE OF U.P. AND 7 OTHERS

Decided

Holding

The High Court, exercising its supervisory jurisdiction under Article 227, directed the Additional Chief Judicial Magistrate to dispose of the pending complaint within one year.

Summary

The petitioner, Lalit Kumar, filed a petition under Article 227 of the Constitution seeking a direction to the Additional Chief Judicial Magistrate, Court No. 3, Meerut, to conclude a pending criminal complaint (Case No. 129/2023) filed under Sections 417 and 494 of the IPC. The petitioner argued that the proceedings were unduly delayed and that a time‑bound disposal was necessary for justice. The High Court considered the facts and the petitioner's submission that he is the complainant. Exercising its supervisory jurisdiction, the Court ordered the magistrate to decide the complaint expeditiously, preferably within one year of the certified copy of the order. The petition was therefore disposed with the said direction.

Issues considered

  • Whether the High Court can, under its supervisory jurisdiction under Article 227, direct a magistrate to dispose of a pending criminal complaint within a specified time frame?
  • Whether the delay in the disposal of the criminal complaint warrants such supervisory intervention?
