Allahabad High Court

PRAMOD DWIVEDIversusRAJ KUMAR AND 9 OTHERS

Decided

Holding

The High Court, invoking its supervisory jurisdiction under Article 227, directed the District Judge to dispose of the election petition within six months without deciding the merits.

Summary

Petitioner Pramod Dwivedi filed an election petition before the District Judge, Fatehpur, challenging the election of the Chairman of Nagar Palika Parishad Fatehpur under Sections 19 and 20 of the U.P. Municipalities Act, 1916. The petition, pending since 3 June 2023, sought an order for its expeditious disposal. The High Court, exercising its supervisory jurisdiction under Article 227 of the Constitution, directed the District Judge to decide the election petition within six months of the certified copy of the order, without calling for a counter‑affidavit or issuing notice. The Court clarified that it had not adjudicated the merits of the election dispute. Accordingly, the petition was disposed with the direction to the lower court.
