Allahabad High Court

RAM MURTI MISHRAversusTHE U.P. STATE PUBLIC SERVICE TRIBUNAL AND 4 OTHERS

Decided

Holding

The Court directed the Uttar Pradesh State Public Service Tribunal to decide the pending claim petition within six months, without deciding the merits of the petition.

Summary

Petitioner Ram Murti Mishra filed a writ petition under Article 227 seeking an order directing the Uttar Pradesh State Public Service Tribunal to expeditiously decide his pending claim petition (No. 2343/2018). The petition contained no other relief and no counter‑affidavit was filed. The High Court, noting that the sole purpose was to obtain a direction for speedy disposal, disposed of the writ petition at the admission stage without hearing the respondents. The Court expressly stated that it did not adjudicate the merits of the underlying claim petition.

                                                    HON'BLE ROHIT RANJAN AGARWAL, J.

                                    1. This writ petition has been filed with the following prayer:-

"a) Issue, an order or direction, directing the Respondent No. 1 to
expeditiously decide the Claim Petition No. 2343/2018 (Ram Murti
Mishra Vs. State of UP and Others)."

                                    2. It is contended by learned counsel for the petitioner that a claim petition
has been filed before U.P. State Public Service Tribunal, Lucknow, which is
pending consideration. The sole prayer made in the writ petition is for
                                    expeditious disposal of the same.

                                    3. As no useful purpose would be served in keeping the matter pending, the
writ petition is being disposed of, at the admission stage, without calling for
counter affidavit or issuing notice to private respondents, with a direction
upon tribunal concerned to decide the Claim Petition No. 2343 of 2018
(Ram Murti Mishra vs. State of UP and Others), in accordance with law,
after hearing all affected parties, preferably within a period of six months
from the date of production of certified copy of this order.

                                    4. With the aforesaid directions, writ petition stands disposed of.

                                    5. It is made clear that this Court has not adjudicated the matter on merits.

                                                                                      (Rohit Ranjan Agarwal,J.)
