Allahabad High Court

SHIV ACHALversusHINDALCO INDUSTRIES LTD AND 3 OTHERS

Decided

Holding

The court set aside the dismissal for default, condoned the delay, and restored the appeal to its original number.

Summary

Shiv Achal, claiming ownership of a 0.24‑hectare plot in Jokahi village, challenged a decree passed in 2013 that declared Hindalco Industries and others as owners. An appeal filed in 2014 was dismissed for non‑appearance on 20 September 2023, and his subsequent application under Order 41 Rule 19 CPC for restoration was rejected on 5 September 2024. The petitioner argued that illness, the death of his brother and other personal hardships prevented his attendance. The High Court examined whether the default dismissal could be set aside despite the petitioner’s lack of vigilance and whether the delay condonation was permissible. It held that the dismissal and the rejection of the restoration application were set aside, the delay was condoned, and the appeal was restored with directions for an expedited hearing, while also ordering the petitioner to pay modest costs.

Issues considered

  • The appropriateness of setting aside a dismissal for default on the ground of the appellant’s illness and personal hardships.
  • Whether an application under Order 41 Rule 19 CPC can be entertained when the appellant was not vigilant in pursuing the appeal.
  • Whether the court may condone the delay in filing the restoration application.
  • Effect of restoration on pending execution proceedings.

Court No. - 5
                    HON'BLE VIKAS BUDHWAR, J.

1. Heard Sri P.K. Upadhyay, learned counsel for the petitioner / appellant/
defendant and Sri R.K. Singh, learned Standing Counsel, who appears for
respondent no. 2 and Shri Anil Kumar Ray, counsel for the plaintiff-
respondent.

2. The counsel for the rival parties have made a joint statement that they do
not propose to file any further affidavits thus with the consent of the parties,
writ petition is being decided at the fresh stage.

3. The case of the petitioner / appellant/ defendant is that he claims to be the
bhumidhar of arazi no.96-Ка area 0.2400 hectare situated in Village- Jokahi,
Pargana and Tehsil- Duddhi, District-Sonbhadra. The plaintiff-respondents
instituted an Original Suit no. 224 of 2008 (Hindalco Industries ltd.
Renukoot Vs. Shiv Achal and 3 others) before the court of Civil Judge
(S.D.), Sonbhadra seeking declaration that the plaintiff-respondents to be
treated to be the owner of the property instituted by arazi no.96-Ка area
0.2400 hectare situated in Village- Jokahi, Pargana and Tehsil- Duddhi,
District-Sonbhadra. Post contest, the suit was decreased on 19.12.2013 by
the Civil Judge (Senior Division), Sonbhadra on 19.12.2013 against which a
Civil Appeal No. 03 of 2014 came to be dismissed for non prosecution on
20.09.2023. A restoration application under Order 41 Rule 19 CPC came to

                                                                      A227 No. 13625 of 2024
                                          2

were justifiable grounds which prevented the petitioner / appellant/
defendant to appear on the date fixed in the appeal, particularly when post
Covid, the brother of the petitioner died and the petitioner being old aged is
also suffering from hurt problem. Submission is that it might be on several
dates, the petitioner / appellant/ defendant was not present but a liberal
approach ought to have been adopted by the appellate court while allowing
the application under order 41 Rule 19 of the CPC in that regard.

7. Shri Anil Kumar Ray who appears for the contesting plaintiff-respondents
submits that whatever might be the conduct of the petitioner / appellant/
defendant dis-entitles it for any relief and rightly the case was dismissed in
default and application under order 41 of Rule 19 CPC was rejected.
Submission is that a litigant who is not alert and vigilant towards his right
cannot claim any insistence for restoration of the proceedings.

8. I have heard learned counsel for the parties and gone through the records
carefully.

9. The facts are not in issue. The declaratory suit instituted by the plaintiff-
respondents came to be decreed on 19.12.2013 against which an Civil

12. On opposition, the same came to be rejected. The consideration which
weighed with the court below was that the petitioner/ appellant/ defendant
was not vigilant and further the theory so propounded that the earlier counsel
had been made the counsel for the NTPC and post engagement of counsel,
                                                          A227 No. 13625 of 2024
                                 5

the application came to be preferred and since the petitioner / appellant/
defendant had not been participating in the proceedings on several
occasions, thus, the application under order 41 Rule 19 CPC cannot be said
to be bona fide.

13. In the opinion of the Court, whatever might the appellate court in the
facts and circumstances of the matter wherein the petitioner/ appellant/
defendant is an individual who has taken the ground of illness and the death
of the brother though the documents were not appended then too fact and the
circumstances necessitated that the matter ought to have been heard on
merits and not throttled on technicalities. The some condition ought to have
been put to service by the court below while giving an opportunity to contest
the proceedings.

14. At this stage, Shri Anil Kumar who appears for the plaintiff-respondents
submits that dialtory tactics is being adopted, thus, the ground may not be
taken by the petitioner/ appellant/ defendant that the appeal is pending so the
execution cannot go on.

15. In view of the aforesaid facts and circumstances, the petition is being
decided in the following manner:

(a) The order dated 20.09.2023 passed Additional District Judge, Court No.
1, Sonbhadra in Civil Appeal No. 03 of 2014 as well as the order dated
05.09.2024 passed by the Additional District Judge, Court No. 1, Sonbhadra
are set aside.

(b) The delay is condoned in filing the application under order 41 Rule 19
CPC.

(c) The appeal is restored to its original number.

(d) The appellate court shall make an endeavour to decide the appeal with
most expedition without granting adjournments and in case adjournments are
sought then the same should be in exceptional circumstances not beyond ten
days at a stretch.

16. At this stage, Shri Anil Kumar submits that execution proceedings will
be hampered, in case, the appeal stands restored.

17. In the opinion of the court, there happens to be provision contained
under order 41 Rule 5 CPC which is already there, thus, no observation is
required.
                                                                                          A227 No. 13625 of 2024
                                                                    6

                                    18. At this stage, Shri P.K. Upadhyay submits that his client, as per
instructions, will pay a cost of Rs. 7,500/- to the plaintiff-respondents.

                                    19. Accordingly, the petition stands disposed of.
                                    May 14, 2026
