The High Court may direct a lower civil court to decide a pending application without adjudicating the merits of the writ petition.
Summary
The petitioners filed a writ petition under Article 227 seeking a direction to the Civil Judge (Senior Division) of Auraiya to decide a pending 6‑C application in Suit No.165 of 2026. The High Court, finding no merit to be adjudicated and deeming the matter suitable for disposal at the admission stage, dismissed the petition without calling for a counter‑affidavit or issuing notice to private respondents. However, the Court directed the Civil Judge to decide the 6‑C application in accordance with law, after hearing all affected parties, preferably within one month of the order. The direction was issued to ensure timely disposal of the pending application. The Court clarified that it had not decided the substantive issues of the case.
