The Court directed the Civil Judge to decide the 6‑C2 application and disposed of the writ petition without reaching the merits.
Summary
The petition was filed by Ved Prakash seeking a direction to the Senior Division Civil Judge, Basti, to decide a 6‑C2 application pending in Original Suit No. 476 of 2026. The High Court, exercising its supervisory jurisdiction under Article 227, noted that keeping the matter pending served no useful purpose. At the admission stage, the Court disposed of the writ without calling for a counter‑affidavit or issuing notice to the private respondents. It directed the civil judge to decide the 6‑C2 application in accordance with law, after hearing all affected parties, preferably within one month of the certified copy of the order. The Court expressly stated that it had not adjudicated the merits of the underlying suit.
