Allahabad High Court

UDHAN SINGH AND ANOTHERversusDISTRICT MAGISTRATE AND 2 OTHERS

Decided

Holding

The writ petition is disposed of, with a direction that the Civil Judge decide the temporary injunction application expeditiously, preferably within one year.

Summary

The petitioners sought a writ directing the Civil Judge (J.D.), City, Farrukhabad to decide a temporary injunction application (6‑C2) filed in Original Suit No. 531 of 2025 and to maintain status quo over the disputed property. The High Court noted that the underlying suit was already pending and that keeping the writ petition alive would serve no useful purpose. Consequently, the Court disposed of the writ petition but issued a direction that the civil judge decide the injunction application expeditiously, preferably within one year, without unnecessary adjournments, subject to any legal impediment. No notices were issued to the respondents. The order thus combines disposal of the writ with a specific time‑bound directive to the lower court.

Issues considered

  • Whether the writ petition seeking a direction to the Civil Judge to decide a pending temporary injunction application should be entertained
  • Whether the High Court can impose a time‑bound schedule for the disposal of the injunction application

                                                          HON'BLE VIKAS BUDHWAR, J.

                                    1. Heard.

                                    2. In view of the order, which is being proposed to be passed today, notices
are not being issued to the respondents.

                                    3. The solitary relief claimed in the present writ petition is for a direction to
the Civil Judge (J.D.), City, Farrukhabad to decide temporary injunction
application 6-C2 filed by the plaintiffs/petitioners in Original Suit No. 531 of

in accordance with law and further during the pendency of the Suit or till the
disposal of 6-C2 application, the parties of the case may kindly be directed
to maintain status quo with regard to property in question..

                                    4. Since the above-mentioned case is pending, no useful purpose would be
served in keeping this petition pending.

                                    5. In view of the above, this writ petition stands disposed of with a direction
to the Civil Judge (J.D.), City, Farrukhabad to decide temporary injunction
application 6-C2 filed by the plaintiffs/petitioners in Original Suit No. 531 of
