Allahabad High Court

SABIYA AND 4 OTHERSversusTHE STATE OF U.P. AND 9 OTHERS

Decided

Holding

The writ petition is dismissed as wholly misconceived.

Summary

The petitioners filed a writ petition under Article 227 seeking the High Court's assistance to enforce an injunction order previously passed by the trial court. The petition alleged that the lower court had not complied with its own injunction. The High Court examined the petition and found it to be wholly misconceived, concluding that the appropriate remedy was to approach the trial court directly for compliance. Consequently, the Court dismissed the writ petition. However, the Court directed that the petitioners remain free to approach the lower court to enforce the injunction.
