The High Court directed the Civil Judge (J.D) F.T.C Jaunpur to decide the pending suit expeditiously, preferably within eighteen months, exercising its supervisory jurisdiction under Article 227.
Summary
The petitioner, Gyanandra Oratap Maurya, filed a petition under Article 227 seeking a direction to the district judiciary to expedite the disposal of an original civil suit (No. 528 of 2003) pending before the Civil Judge (J.D) at F.T.C Jaunpur. The suit, initiated in 2003, had seen multiple dates fixed but remained undecided, prompting the petitioner to request judicial intervention for timely resolution. The High Court examined the order sheet and noted the prolonged delay without expressing any view on the merits of the underlying civil dispute. Relying on its supervisory jurisdiction under Article 227, the Court deemed the petition appropriate for disposal and issued a directive for the lower court to decide the suit within eighteen months of receiving a certified copy of the order. The direction emphasized that the lower court must hear all parties, allow evidence, and ensure no other legal impediment exists. Consequently, the petition was disposed of with the expeditious disposal direction.
