MEENA DEVIversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The petition is dismissed as withdrawn, with liberty granted to the petitioner to file a protest petition challenging the final report.

Summary

Meena Devi filed a petition under Article 227 of the Constitution challenging actions of the State of Uttar Pradesh and three other respondents. The Attorney General informed the court that a re‑investigation had been completed and a final report was submitted on 26 December 2024. The petitioner sought permission to withdraw the present petition and instead file a protest petition contesting the final report. The court considered whether the petition could be withdrawn and whether the petitioner could be granted liberty to approach the court later. It held that the petition could be withdrawn and granted the requested liberty. Consequently, the petition was dismissed as withdrawn with liberty to file a protest petition.
