Allahabad High Court

MEERA DEVIversusRAJENDRA YADAV

Decided

Holding

The writ petition is disposed of with a direction to the lower court to decide the pending civil suit expeditiously, ensuring service of notice and hearing to all parties.

Summary

The petitioner Meera Devi filed a writ petition under Article 227 seeking a direction that the Civil Suit No. 303 of 2014 (Mangla Yadav v. Ramkrit Yadav) pending before the Civil Judge (Junior Division) at Chandauli be decided within a stipulated time. The petition alleged that the suit was pending without expeditious disposal. The High Court observed that since the suit was still pending, the writ petition had no further purpose and could be disposed of. The Court ordered the writ petition to be dismissed and directed the lower court to decide the civil suit expeditiously, ensuring that all respondents are served notice and given an opportunity to be heard and present evidence, subject to no other legal impediment. The order was pronounced on May 18, 2026.
