Holding
The High Court held that it may issue a direction to the Family Court to dispose of the pending case within six months under its supervisory jurisdiction.
Summary
The petitioner, Avanish Kumar, filed a writ petition under Article 227 seeking a direction to the Additional Principal Judge of the Family Court, Fatehpur, to decide the pending Misc. Case No. 273 of 2025 (Avanish Kumar v. Amita Devi) expeditiously. The petitioner argued that the lower court had delayed the proceedings and requested a time‑bound order. The Court considered its supervisory jurisdiction under Article 227 and the need for speedy disposal of family matters. It held that it could issue a directive to the lower court to conclude the case within a specified period. Accordingly, the petition was disposed of with an order directing the Family Court to decide the case within six months from the production of the certified copy of the order.
