Allahabad High Court

SRIRAM @ SANDEEP AND 4 OTHERSversusOM PRAKASH AND ANOTHER

Decided

Holding

The writ petition is disposed of with a direction to the Civil Judge (J.D.) to decide the pending suit expeditiously.

Summary

The petitioners, Sriram @ Sandeep and others, filed a writ petition under Article 227 seeking a direction to the Civil Judge (J.D.) of Court No. 10, Deoria, to decide Suit No. 539 of 2022 (Om Prakash and another v. Sriram @ Sandeep and others) within a time‑bound period. The sole relief claimed was an order for expeditious disposal of the pending suit. The Court observed that the suit was already pending and that keeping the writ petition alive would serve no useful purpose. Consequently, the Court disposed of the writ petition and directed the lower court to decide the suit expeditiously as per the roster. No substantive merits of the underlying suit were examined; the decision was limited to procedural direction under the supervisory jurisdiction of the High Court.
