Allahabad High Court

VANDANA DEVI AND ANOTHERversusRAMBHA YADAV

Decided

Holding

The High Court directed the Civil Judge to decide the temporary injunction application within eight months and disposed of the writ petition.

Summary

The petitioners sought a direction from the Allahabad High Court under Article 227 to compel the Civil Judge (Senior Division) in Varanasi to decide a temporary injunction application (paper no. 6 C) filed in Original Suit No. 337 of 2025. The High Court noted that the original suit was still pending and that keeping the writ petition alive would serve no useful purpose. Consequently, the Court disposed of the writ petition, but issued a directive that the civil judge decide the injunction application expeditiously, preferably within eight months, without unnecessary adjournments, subject to any legal impediment. No notices were issued to the respondents. The order was signed on May 6, 2026.

                                    2. In view of the order, which is being proposed to be passed today, notices
are not being issued to the respondents.

                                    3. The solitary relief claimed in the present writ petition is for a direction to
the Civil Judge (Senior Division), Varanasi, to decide temporary injunction
application paper no. 6 C filed in Original Suit No. 337 of 2025 (Vandana
Devi and others Versus Rambha Yadav) pending before him within
stipulated period of time as fixed by this Hon'ble High Court.

                                    4. Learned counsel prayed that the said suit may be decided, expeditiously.

                                    5. Since the above-mentioned case is pending, no useful purpose would be
served in keeping this petition pending.

                                    6. In view of the above, this writ petition stands disposed of with a direction
