Allahabad High Court

RANDHEER SINGHversusTABREJ ALI

Decided

Holding

The High Court directed the Civil Judge (Junior Division), Muzaffarnagar to decide the pending civil suit expeditiously, without granting unnecessary adjournments, subject to legal impediment.

Summary

The petitioner, Randheer Singh, filed a writ petition under Article 227 seeking a direction to the Civil Judge (Junior Division), Muzaffarnagar, to decide Civil Suit No. 646 of 2017 (Randheer Singh v. Tabrej Ali) within a fixed period of three months and without unnecessary adjournments. The petition argued that the pending suit required expeditious disposal. The High Court noted that keeping the writ petition pending would serve no useful purpose while the suit remained unresolved. Consequently, the Court disposed of the writ petition, issuing a direction to the civil judge to decide the suit expeditiously, subject to any legal impediment. No notices were issued to the respondent, and the petition was dismissed with the specified direction.

  • Whether the writ petition is maintainable when the suit in question is still pending

                                    Counsel for Respondent(s)              :

                                    Court No. - 5
                                                          HON'BLE VIKAS BUDHWAR, J.

                                    1. Heard.

                                    2. In view of the order, which is being proposed to be passed today, notices
are not being issued to the respondents.

                                    3. The solitary relief claimed in the present writ petition is for a direction to
the Civil Judge (Junior Division), Muzaffarnagar to expeditiously decide the
Civil Suit No. 646 of 2017 (Ranadheer Singh vs. Tabrej Ali) within a fixed
and stipulated period, preferably within three months, without granting
unnecessary adjournments to either of the parties.

                                    4. Learned counsel prayed that the said suit may be decided, expeditiously.

                                    5. Since the above-mentioned case is pending, no useful purpose would be
served in keeping this petition pending.

                                    6. In view of the above, this writ petition stands disposed of with a direction
to the Civil Judge (Junior Division), Muzaffarnagar to expeditiously decide
the Civil Suit No. 646 of 2017 (Ranadheer Singh vs. Tabrej Ali),
expeditiously, without granting any unnecessary adjournments, subject to
                                     legal impediment.
