Allahabad High Court

ARUN KUMARversusSTATE OF U.P. AND 5 OTHERS

Decided

Holding

The High Court directed the Additional District Judge (POCSO), Shamli, to decide Criminal Revision No.45/2024 within six months of the order.

Summary

The petitioner, Arun Kumar, filed a writ petition under Article 227 seeking a direction to the Additional District Judge (POCSO), Shamli, to decide Criminal Revision No.45/2024, which has been pending since 2024. The petitioner argued that the delay violated the principle of speedy justice and requested a time‑bound order. The Court examined whether it could intervene under its supervisory jurisdiction to impose a deadline on the lower court. Considering the facts and the petitioner's submission, the Court held that it was appropriate to issue such a direction to ensure timely disposal. Consequently, the petition was disposed with an order directing the Additional District Judge to decide the revision within six months of receiving a certified copy of the order.
