Allahabad High Court

KULDEEP KUMAR AND 3 OTHERSversusSATYAVEER SINGH AND 6 OTHERS

Decided

Holding

The writ petition is disposed of with a direction to the Small Causes Court, Moradabad, to decide the ad interim injunction application within eight months, without unnecessary adjournments.

Summary

The petitioners, Kuldeep Kumar and three others, filed a writ petition under Article 227 seeking a direction to the Small Causes Court, Moradabad, to decide an ad interim injunction application (paper 6-C) in Original Suit No. 1047 of 2024. The petition alleged that the suit was pending and required expeditious disposal. The Court noted that keeping the writ petition pending served no useful purpose while the underlying suit was still pending. Consequently, the Court disposed of the writ petition, directing the Small Causes Court to decide the injunction application within eight months, without unnecessary adjournments, subject to legal impediments. The order was pronounced on May 6, 2026, by Justice Vikas Budhwar.

                                    2. In view of the order, which is being proposed to be passed today, notices
are not being issued to the respondents.

                                    3. The solitary relief claimed in the present writ petition is for a direction to
the Judge small causes Court Moradabad to decide the ad interim injunction
application paper number 6-C in Original Suit No. 1047 of 2024 (Computer

                                    4. Learned counsel prayed that the said suit may be decided, expeditiously.

                                    5. Since the above-mentioned case is pending, no useful purpose would be
served in keeping this petition pending.
