Allahabad High Court

MAYA VERMAversusGYANENDRA SINGH AND 3 OTHERS

Decided

Holding

The High Court directed the Civil Judge to decide the pending suit and applications expeditiously, with due notice and hearing, thereby exercising its supervisory jurisdiction under Article 227.

Summary

Maya Verma filed a writ petition under Article 227 seeking a direction to the Civil Judge (Junior Division), Kanpur Nagar, to decide Original Suit No. 20 of 2016 and several pending applications, including a compromise application dated 24‑09‑2019. The High Court observed that the underlying suit and applications remain pending and that keeping the writ petition alive would serve no useful purpose. Consequently, the Court disposed of the writ petition, but issued a direction that the Civil Judge must decide the suit and pending applications expeditiously, after serving notice on all respondents and affording them a hearing and opportunity to lead evidence, provided no other legal impediment exists. The order effectively exercises the Court’s supervisory jurisdiction to ensure the lower court proceeds with the pending matters. The petition was therefore dismissed with the specified direction.
