The writ petition is disposed with a direction to the Civil Judge (Senior Division) Allahabad to decide the application under Order 39 Rule‑1 of the CPC expeditiously, ensuring service of notice and a hearing.

Summary

Smt. Suneeta Devi filed a writ petition seeking a direction to the Civil Judge (Senior Division) Allahabad to decide an application filed on 17‑10‑2022 under Order 39 Rule‑1 of the CPC in Original Suit No. 742/2022. The petitioner argued that the application should be decided expeditiously. The Court observed that the suit was already pending and that keeping the writ petition alive would serve no useful purpose. Consequently, the Court disposed of the writ petition and directed the Civil Judge to decide the application promptly, ensuring that notice is served on all respondents and that they are given a hearing and a reasonable opportunity to lead evidence, subject to the absence of any legal impediment. The order thus aims to expedite the pending civil proceedings while safeguarding procedural fairness.
