Holding
The writ petition is dismissed and the High Court directs the Civil Judge (J.D.), Hawali, Varanasi to decide the original suit as per the regular roster.
Summary
The petitioner, Dheeraj Kumar Patel, filed a writ petition under Article 227 seeking a direction to the Civil Judge (J.D.) of Hawali, Varanasi to decide his original suit (No.2660 of 2025) for dispossession of the defendant expeditiously. The petition sought an order for the civil court to hear and dispose of the suit within a short period. The court noted that the original suit was already pending and that issuing further notices to the respondent would serve no purpose. Consequently, the High Court disposed of the writ petition, directing the civil judge to decide the suit as per the regular roster. No substantive merits of the original suit were addressed; the focus was solely on procedural direction.
