Allahabad High Court

SHYAM KUMARIversusVINOD AND 25 OTHERS

Decided

Holding

The High Court directed the Civil Judge (Junior Division), Jaunpur to decide the pending suit expeditiously, thereby exercising its supervisory jurisdiction under Article 227.

Summary

The petitioner, Shyam Kumari, filed a writ petition under Article 227 seeking a direction to the Civil Judge (Junior Division), Jaunpur, to decide Suit No. 1239 of 2021 (Shyam Kumari v. Vinod & others) within a time frame fixed by the High Court. The petition alleged that the suit was pending and required expeditious disposal. The Court noted that the sole relief sought was the direction for speedy adjudication of the pending suit. Since the suit remained unresolved, the Court found no merit in keeping the writ petition pending. Accordingly, the writ petition was disposed of, with an order directing the Civil Judge to decide the suit expeditiously, subject to any legal impediment.

                                    2. In view of the order, which is being proposed to be passed today, notices
are not being issued to the respondents.

                                    3. The solitary relief claimed in the present writ petition is for a direction to

                                    5. Since the above-mentioned case is pending, no useful purpose would be
served in keeping this petition pending.

                                    6. In view of the above, this writ petition stands disposed of with a direction
